Elixa Skincare – Terms of Use and Sale

1. IMPORTANT PRODUCT SAFETY DISCLOSURE

Our products are designed for cosmetic use only.

It is essential that you read and follow the User Manual and all product instructions before use.

By using any ELIXA product, you acknowledge and assume the inherent risks associated with microneedling and topical applications, including but not limited to temporary redness, irritation, and minor discomfort.

ELIXA shall not be liable for any injury, damage, or loss arising from misuse, failure to follow instructions, or use inconsistent with the intended purpose. Consult your healthcare provider before using any product, particularly if you have existing skin conditions, are pregnant, nursing, or under medical treatment.

2. ACCEPTANCE OF TERMS

These Terms of Use and Sale (“Agreement”) govern your access to and use of www.elixaskincare.com (the “Website”), our mobile applications, and the purchase of our products (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by this Agreement. If you do not agree, you must not use our Services.

3. ELIGIBILITY

You must be at least the age of majority in your country of residence to use our Services or purchase our products. By placing an order, you confirm that you have the legal capacity to enter into a binding agreement.

4. INTERNATIONAL SALES & CONSUMER RIGHTS

We sell globally. If you are a consumer residing outside Australia, mandatory consumer protection laws in your country will apply in addition to these Terms.

We do not guarantee that our products comply with the regulations of your jurisdiction; you are responsible for ensuring compliance before purchase.

5. PRIVACY & SECURITY

6. WEBSITE USE RESTRICTIONS

You agree not to:

Reproduction, distribution, modification, or commercial exploitation without written permission is prohibited.

8. ORDERS & ACCEPTANCE

Placing an order does not guarantee acceptance. We reserve the right to refuse or cancel orders for any reason, including suspected fraud or resale intent.

9. PRICING & PAYMENT

Prices are shown in your selected currency and may be converted based on your payment provider’s exchange rate.

We accept payment via the methods displayed at checkout. You confirm that you are authorised to use the payment method provided.

10. SUBSCRIPTIONS & AUTO-BILLING

When you subscribe to recurring deliveries, you authorise us to automatically bill your payment method at the agreed interval until cancelled.

To cancel, you must notify us at least 24 hours before your next scheduled shipment via email at support@elixaskincare.com.

11. SHIPPING & DELIVERY

We ship internationally. Delivery times vary by location and may be affected by customs clearance or other factors beyond our control.

We are not responsible for incorrect shipping information provided by you.

12. RETURNS & REFUNDS

Returns are accepted within 30 days of delivery for eligible items in accordance with our [Returns Policy].

Certain items are non-returnable for hygiene and safety reasons (e.g., used microneedling devices).

13. SMS & MOBILE MARKETING TERMS

By consenting to Elixa’s SMS marketing at checkout or via our sign-up tools, you agree to receive recurring text messages, including promotions, order updates, and abandoned cart reminders.

Message frequency varies. Message & data rates may apply. You may opt out at any time by replying STOP or following the unsubscribe link in a message.

14. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, all products and services are provided “as is” without warranties of any kind, except where expressly stated in our product warranty.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Elixa Skincare’s total liability for any claim shall not exceed USD $500.

We are not liable for indirect, incidental, or consequential damages, including loss of profits or data.

16. DISPUTE RESOLUTION – MANDATORY ARBITRATION & CLASS ACTION WAIVER

You agree that any dispute arising out of or relating to this Agreement, our products, or Services will be resolved through binding arbitration under the rules of the Australian Centre for International Commercial Arbitration (ACICA).

You waive any right to participate in a class action or jury trial.

You may opt out of this arbitration agreement within 30 days of purchase by emailing legal@elixaskincare.com.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Elixa Skincare, its affiliates, employees, and agents from any claims, damages, or losses arising from your breach of these Terms or misuse of our products.

18. THIRD-PARTY LINKS

We are not responsible for the content or practices of third-party websites linked from our Website. You access such sites at your own risk.

19. TERMINATION

We may suspend or terminate your access to our Services at any time for breach of these Terms.

20. GOVERNING LAW

This Agreement is governed by the laws of New South Wales, Australia, without regard to conflict of laws principles, subject to mandatory consumer laws in your jurisdiction.
